Local Agents : appeal to President Barroso

NOTE FOR THE ATTENTION OF MR BARROSO,
PRESIDENT OF THE EUROPEAN COMMISSION

Subject: Social Security system for the Local Agents in Delegations

Local agents in delegations constitute an essential category of staff for the operations of these offices.

This Staff is recruited according to the local market employment conditions, which often results in an insufficient social protection, when it exists.

This is why, in 2010, during the negotiations of the revision of the Staff Regulations before the creation of the EEAS, the article 121 of the RAA was introduced to allow giving legal basis for the improvement of the social protection system of local staff. In the implementing rules, it is question of determining in which countries this system aiming at a broader social coverage will be implemented. These rules must be elaborated through dialogue with the trade-unions of the staff of the EEAS and of the Commission.

However since 2010, nothing has been done to implement this article, whether it is at the Commission or at the EEAS.

The administration of the EEAS and of the Commission has already been asked for the opening of a dialogue on this issue without yet obtaining it. We also have asked for the opening of a social dialogue specific to the local agents issues and to this date we have not received an official answer.

We have already requested Mrs Ashton and Mr Šefčovič to act on these issues and no reply to this date.

This is why, we ask you to launch the discussions for the implementation of the article 121 of the RAA in order to put an end to very difficult individual situations in certain third countries.

Objet: Régime de sécurité sociale des agents locaux en délégation
 

Les agents locaux dans les délégations constituent un personnel indispensable pour le fonctionnement de ces structures.

Ce personnel est employé selon les conditions du marché local de l'emploi, ce qui se traduit souvent par une protection sociale insuffisante, quand elle existe.

C'est pourquoi, en 2010, lors des négociations de la révision du statut avant la création du SEAE, l'article 121 du RAA a été introduit pour permettre de donner une base légale pour l'amélioration du système de protection sociale des agents locaux. Dans les règles d’application, il s’agit de déterminer dans quels pays ce système visant à une plus large couverture sociale sera mis en oeuvre. Ces règles doivent être élaborées en concertation avec les organisations syndicales du personnel du SEAE et de la Commission.

Or depuis 2010, rien n'a été fait pour mettre en oeuvre cet article, que ce soit à la Commission ou au SEAE.

Il a été déjà demandé à l'administration du SEAE et de la Commission l'ouverture d'une concertation à ce sujet sans pour autant l'obtenir. Nous avons également demandé l'ouverture d'un dialogue social spécifique aux thématiques concernant les Agents locaux et à ce jour nous n'avons pas reçu non plus de réponse officielle.

Nous nous sommes aussi adressés à madame Ashton et Monsieur Šefčovič pour que ce dossier soit traité et encore pas de réponse à ce jour.

C'est pourquoi, nous vous demandons de lancer les discussions pour la mise en oeuvre de l'article 121 du RAA afin de mettre un terme à des situations individuelles très difficiles dans certains pays tiers.

Asunto: La seguridad social de los agentes locales en las delegaciones

Los agentes locales en las delegaciones son un elemento esencial para el buen funcionamiento de las estructuras en el exterior.

El personal está empleado con las condiciones del mercado de trabajo local, que a menudo resulta en una protección social inadecuada, si tal vez existe.

Por eso, en 2010, durante las negociaciones para la revisión del estado de antes de la creación del SEAE, el artículo 121 del ROA fue añadido para dar una base jurídica para mejorar el sistema de protección social de los agentes locales. En las normas de aplicación, se trata de determinar en qué países se llevará a cabo el sistema a una protección social más amplia. Estas reglas deben ser desarrolladas en consulta con los sindicatos del SEAE y de la Comisión.

Desgraciadamente desde 2010 nada se ha hecho para aplicar el presente artículo, sea en la Comisión como en el SEAE.

Se ha pedido a la administración del SEAE y de la Comisión abrir un diálogo al respecto, sin conseguirlo.

También hemos pedido la apertura de un diálogo temático específico sobre los agentes locales y hasta la fecha no hemos recibido ni una respuesta formal.

Hemos también pedido a la Señora Ashton y al Señor Šefčovič que todo esto sea tratado y todavía ninguna respuesta.

Nosotros le pedimos que se inicien las conversaciones para la aplicación del artículo 121 del ROA y acabar con situaciones individuales muy difíciles en algunos países fuera de la Unión Europea.
